The State Court system is basically divided into two separate, but very different, sections: Criminal and Civil. The Criminal Courts deal with charges filed by the State of Indiana against someone accused of committing a crime. The Civil Courts are much more generalized and deal primarily with “torts,” which is best understood as a “civil wrong.” Basically, the Civil Courts are in place to oversee disputes between two parties, including conflicts between individuals and businesses, family law matters like divorce and child support, and dealing with trusts and estates.
While both Courts have similar rules, the power of each Court is very different. A Criminal Court can only deal with the facts, circumstances, and punishment associated with a crime. And, for the most part, the Civil Courts only deal with financial issues and restricting prohibited behavior. Keep in mind, not every civil case has an obvious solution, but the resolution is almost always about recovering money.
